Heard Sri Y.D. Sharma, learned counsel for the petitioner and Sri Abhishek Srivastava for respondents no. 1 and 2.
The petitioner has been served with the provisional assessment dated 29.7.2019 regarding unauthorized use of electricity to the tune of Rs. 19,66,876/-. The petitioner is said to have filed objections dated 14.9.2019 against the said provisional assessment before the Executive Engineer.
The contention of learned counsel for the petitioner is his aforesaid objections are not being considered and decided.
Sri Abhishek Srivastava submits that in case objections against the provisional assessment have not been decided finally, the Executive Engineer shall consider and decide the same expeditiously.
In view of the aforesaid facts and circumstances, the writ petition is disposed of with the direction to the Executive Engineer, respondent no. 2 to consider and decide the aforesaid objections of the petitioner pursuant to the provisional assessment in accordance with law most expeditiously, if possible, within a period of one month from the date a copy of this order is produced before him provided the objections have not already been decided.
