Heard Sri Rajesh Kumar Mishra, learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
The grievance of the petitioner is that the petitioner Institution has not been notified as an examination centre for conducting the Intermediate Examination for the year 2019.
The petitioner has submitted a representation in this regard on-line on 12.11.2018. The representation was submitted in pursuance of the notification dated 10.11.2018. No action has been taken on the aforesaid representation. Learned counsel for the petitioner further submits that the petitioner Institution has been discriminated against. Institutions which are not having required infrastructural facilities like C.C.T.V., Voice Recording and so on, have been notified as examination centres. The petitioner Institution has been left out despite having the requisite facilities.
Learned Standing Counsel for the State- respondents submits that the issue is factual in nature and needs to be verified by the competent authority.
No useful purpose will be served by keeping the writ petition pending. The writ petition is being disposed of finally with the consent of the parties.
The matter is remitted back to the respondent no. 3, District Inspector of Schools, Rampur, District Rampur.
A mandamus is issued to the respondent no. 3 commanding him to decide the representation of the petitioner for being notified as an examination centre to conduct in the Intermediate Examination-2019 within a period of one month from the date of receipt of a certified copy of this order.
It is clarified that this Court has not judged merits of the claim of the petitioner or the veracity of the assertions made in the writ petition. It is for the competent authority to do so after independent application of mind.
The writ petition is disposed of finally.
