By way of the instant appeal, challenge has been made to the validity and sustainability of the judgment and order of conviction dated 14.4.1983, passed by IVth Additional Sessions Judge, Moradabad, in Sessions Trial No.76 of 1980, (State Vs. Tej Ram and Others), under Section - 302 read with Section - 34 I.P.C., Police Station - Katghar, District - Morabad, whereby the appellants have been sentenced to undergo life imprisonment.
From perusal of the report of Chief Judicial Magistrate, Moradabad, dated 30.11.2019, it transpires that appellant no.1- Tej Ram, appellant no.2- Ram Autar, appellant no.3- Narottam and appellant no.-4 Shyam Lal, in this case have died.
In view of above, this appeal is liable to be dismissed as abated. The present appeal is, accordingly, dismissed.
