Notice on behalf of all opposite parties has been accepted by the learned Chief Standing Counsel.
The writ petition has been filed seeking reliefs:-
"(i) Issue a writ order or direction in the nature of MANDAMUS commanding to respondent authority concerned directing thereby to act strictly as per proposed proposal of village panchayat contained in this writ petition as annexure no.1.
(ii) Issue a writ or direction in the nature of MANDAMUS commanding to respondent authority concerned directing thereby to decide the last representation given vide dated 16.01.2021 by petitioner to respondent authority no.2 concerned i.e. District Magistrate Hardoi and direct to authority concerned to pass speaking and reasoned order within stipulated time frame as deemed fit and proper to this hon'ble court for the end of justice representation contained n this writ petition as annexure no. 4.
(iii) Issue any writ, order or direction which may be deemed fit and proper under the facts and circumstances may also be passed in the interest of justice.
(iv) Allow the petition in the favour of petitioner."
Learned Standing Counsel has taken an objection regarding maintainability of the writ petition on the ground that the petitioner has no locus standi to seek relief, as prayed in the writ petition.
Sri Hari Narayan Singh, learned counsel for the petitioner, at this stage, makes a statement at the Bar that he may be permitted to withdraw the writ petition with liberty to approach the authority concerned.
The writ petition is accordingly dismissed as withdrawn with the aforesaid liberty.
