Heard learned counsel for the petitioner and the learned AGA appearing for the State.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. in Case Crime No. 425 of 2017, under Sections 2/3 of U.P. Gangster and Anti Social Activities (Prevention) Act, 1986, Police Station Chhatari, District Bulandshahar.
From the perusal of the first information report, it appears that on the basis of the allegations made therein prima facie cognizable offence is made out. Therefore, the prayer for quashing the impugned F.I.R. is refused.
However, considering the facts and circumstances of the case, we dispose of this petition with a direction that in case the petitioner surrenders and applies for bail within three weeks from today before the Court below, the same shall be considered and decided expeditiously on its intrinsic merit by the Court below in accordance with the provisions of the U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986.
