Heard learned counsel for the applicant, learned AGA and perused the record.
Learned counsel for the applicant submits that the applicant is a chela of late Mohant Sri Surya Narain Das, the founder of the Math Mandir, Kuti Khaira Khara situated in District Ballia. Mohant Surya Narain Dass has executed a will deed in favour of the applicant Raghvendra Dass and three others, namely Janaki Sharan Dass, Rameshwar Dass and Siya Ram Dass. The applicant has filed a civil suit no. 806 of 2016 for injunction against Janaki Sharan Dass and others. In that case, an order of temporary injunction was passed by the court concerned on 29.3.2017. In Pariwar register, the applicant has been shown as dead and his date of birth has been shown as 26.7.1927. In fact the date of birth of the applicant is 11.3.1986. The applicant has moved a correction application in pariwar register and after enquiry the relevant error was corrected by the concerned authority. The applicant has not committed any forgery and he has not prepared any forged document. In fact no offence is made out against the applicant. The applicant has been falsely implicated in this case. There is no criminal history of the applicant and is in jail since 25.11.2018.
Per contra, learned AGA opposed the prayer for bail.
Having given my thoughtful consideration to the submissions of the learned counsel for the parties, without expressing any opinion on the merits of the case, I am of the opinion that it is a fit case for bail.
Let the applicant Teepu Tiwari Alias Mohunt Raghvendra Dass involved in Case Crime No.210 of 2018 under Section 419, 420, 467, 468, 471 IPC Police Station Ubhaon District Ballia be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions;
1. The applicant will not tamper with the evidences.
2. The applicant will not pressurize/intimidate the prosecution witnesses and will cooperate with the trial.
3. The applicant will appear on each and every date fixed by the trial court unless personal appearance is exempted by the court concerned.
In case of breach of any conditions mentioned above, the trial court shall be at liberty to cancel the bail of the applicant.
