1. Solitary grievance of the petitioner appears to be that his partition suit being Case No. T2018054404402905 (Teekar Vs. Radhey Shyam & Ors.), filed under Section 116 of U.P. Revenue Code, 2006, before respondent no.2-Sub-Divisional Magistrate, Tehsil-Kasya, Disrict- Kushinagar, has remained pending since 23.01.2020. In that regard, it has been submitted that though the suit itself is of the year 2018, has become pending before respondent no.2 on account of an order of remand dated 23.01.2020.
2. Keeping in mind the facts noted above, without entering into the merits of the case, the present writ petition is disposed of with a direction to the respondent no.2-Sub-Divisional Magistrate, Tehsil-Kasya, Disrict- Kushinagar, to decide the aforesaid case, as expeditiously as possible, strictly in accordance with law, preferably within a period of six months from the date of production of a copy of this order, if there is no legal impediment provided the petitioner does not seek any adjournment during that period and cooperates in the proceedings.
