JUDGMENT / ORDER

The petitioners are aggrieved by the detention of the goods transported inter-State. The Detaining Officer is of the opinion that the petitioner is not a registered dealer within the State. However, the petitioner has produced Ext.P2 Certificate of Registration and also Ext.P3 return, which evidences the compounding having been applied for and granted. In such circumstance, there is no reason why the goods be detained and the security deposit demanded. In such circumstance, there shall be a direction that the petitioner shall be granted release of the goods expeditiously, on production of the certified copy of this judgment and on execution of simple bond without sureties. Before the adjudication WPC No.16130/2014 ::2:: proceedings are proceeded with, the Intelligence Officer shall verify as to whether a registration is granted to the petitioner, within the State and if so, there absolutely no need for the adjudication proceedings to be carried out.
Writ petition is disposed of.
