Heard learned counsel for the petitioner and Sri P.K. Giri, learned Additional Chief Standing Counsel.
In compliance of the order of this Court today Sri Balram Singh, Additional District Magistrate (Land Acquisition), Gautam Buddha Nagar, is present before this Court along with application seeking exemption of District Magistrate, Gautam Buddha Nagar from personal appearance on the ground that due to agitation of farmers in the area, some administrative exigency has arisen otherwise the District Magistrate would have been present in compliance of the order of this Court.
Exemption application filed along with compliance affidavit is taken on record.
In the application itself it has been stated clearly that land acquisition reference was made by the then District Magistrate on 9th March, 2018 to the District Judge concerned and copy thereof was also dispatched to the applicant. Consequently, the land acquisition reference was registered as LA.R. No.- 53 of 2018 and 29th May, 2018 onward 28 dates have been fixed and therefore, it is submitted that the District Magistrate has already made a reference and, therefore, no further compliance was necessary as no reference can be made for the second time.
Having considered the pleas raised in the application supported by an affidavit, I find that reference is now pending before the District Judge concerned being L.A.R. No. 53 of 2018 and now the petitioner has notice thereof and, therefore, he may appear before the District Judge concerned and get the matter decided quite expeditiously. It is undertaken by the petitioner that he will cooperate in the disposal of the pending reference.
In such above view it is expected that reference pending since 2018 shall stand answered in accordance with law within the next 3 months' time after appearance of the applicant.
In view of the above facts and circumstances, exemption application stands allowed.
Since the reference has already been made, no further cause survives to the applicant to maintain this contempt application.
The contempt application is, accordingly, consigned to records. Notices issued, if any, stand discharged.
