T.Chandrasekar vs M/S.Colour India Firms

Madras High Court|25 January, 2017

JUDGMENT / ORDER

The revision petition is filed against the order dated 01.09.2014 passed in Memo in R.C.O.P.No.156 of 2011 filed by the tenant. The memo is to the effect that the tenant, who was originally a Private Limited Company, has now become a Partnership Firm with the name 'New Color India Films'. It is also stated that there was a letter to that effect, which was sent to the landlord on 01.04.2013. Since there was no response and the landlord did not care to amend the cause title, the Memo had been filed and the same was allowed. If the landlord is aggrieved by the said Memo, he should have filed an appeal before the Appellate Authority and ought not to have rushed to this Court by way of filing Civil Revision Petition. Therefore, the Civil Revision Petition is dismissed as not maintainable. Accordingly, the Civil Revision Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
25.01.2017 srn Note: The Registry is directed to return the certified copy to the learned counsel for the petitioner.
To The XIV Small Causes Judge, Chennai.
