Ext. P1 order of transfer is challenged in this writ petition which was filed as early as in the year 2009. Ext. P1 is an order through which the petitioner was relieved from Poovar Depot of the 1st respondent Corporation in pursuance of an order of transfer to Vellanadu Depot. Petitioner contended that the transfer was ordered based on a disciplinary action initiated and the charges upon which such action was initiated is totally unsustainable. It is noticed that this court had issued an interim order staying operation of Ext.P1 transfer order and directing the respondents to reinstate the petitioner at Poovar Depot on 13.11.2009. Learned counsel for the petitioner submitted that the petitioner was re-admitted at Poovar Depot consequent to the interim direction and he continued there till his retirement on 31.3.2010. He further seeks direction to treat the leave period availed after Ext.P1 order as duty. It is a matter which need be WP(C). 32142 /2009 2 decided by the appropriate authority in the 1st respondent Corporation on the basis of finalisation of the disciplinary action.
3. Hence this writ petition is disposed of reserving liberty to the petitioner to seek appropriate decision in the matter from the competent authority in the 1st respondent Corporation.
