T.Balaiah vs The District Revenue Officer

Madras High Court|14 February, 2017

JUDGMENT / ORDER

This Writ Petition has been filed, seeking for issuance of a writ of Certiorari calling for the records pertaining to the impugned order in Na.Ka.No.A5/52784/2015, dated 18.1.2017 on the file of the first respondent and to quash the same as illegal.
2.Mr.A.K.Baskarapandian, learned Special Government Pleader takes notice for the respondents. By consent of both parties, the Writ Petition itself is taken up for final disposal at the admission stage itself.
3.The Petitioner has come forward with this Writ Petition challenging the charge-sheet filed against him. The learned counsel for the Petitioner submit that there is no FIR filed against the Petitioner for the incident in question. He would further submit that the incident took place on 15.7.2014 and that the Petitioner has not been furnished with the copies of documents.
4.However, this Court is not inclined to quash the charge-sheet. However, document that is going to be relied upon by the respondents has to be furnished to the Petitioner in order to defend his enquiry. Since the Petitioner is at the age of retirement, the respondent concerned is directed to commence the enquiry and proceed with the same on day-to-day basis, without adjourning the matter beyond three days at any point of time.
5.With the above direction, the Writ Petition stands disposed of. No costs.
To:
1.The District Revenue Officer, Office of the District Revenue Officer, Ramanathapuram District.
2.The Revenue Divisional Officer, Ramanathapuram Taluk, Ramanathapuram District.
