Heard Shri Ashish Dwivedi, learned counsel for the petitioner and the learned Standing Counsel for the respondents.
The petitioner is seeking quashing of the orders dated 24.04.2018, 10.05.2018 and 10.05.2018. By the first impugned order he has been placed under suspension, by the second impugned order dated 1.05.2010 he has been attached to Nagar Panchayat, Devraniya and by the third impugned order he has been asked to hand over all the papers of the office to Clerk, Mohd. Asfaq Khan.
The allegations against the petitioner are of unauthorizedly absence from duty, disobedience of the order of the superior authority and using unparliamentary language with the colleagues and public.
Considering the allegations in the impugned order, I am not inclined to interfere with the order of suspension.
The writ petition is dismissed.
However, in case if no chargesheet has been issued to the petitioner and the respondents intend to hold a departmental enquiry against him, they shall issue a charge sheet to the petitioner within 15 days from the date of receipt of a certified copy of this order and thereafter the enquiry shall be concluded within a further period of three months.
The order of suspension shall be subject to any final order which may be passed in the departmental enquiry.
It is expected that the petitioner will fully cooperate with the departmental enquiry and no unnecessary adjournments will be granted to either of the parties.
