Heard Shri Kailash Nath Singh, learned counsel for the petitioner, the learned Standing Counsel and perused the record.
Present petition has been filed for early disposal of Reference No. 108/2020-21 under Section 48(3) of the U.P. Consolidation of Holdings Act.
It is submitted by the learned counsel for the petitioner that the petitioner has moved an application dated 17.03.2021 under Section 48(3) of the U.P. Consolidation of Holdings Act, 1953 (Annexure No.1) before the Deputy Director of Consolidation, Jaunpur in respect of plot no. 574/3. On the said application, the Deputy Director of Consolidation, Jaunpur has called for the report on the same day but till date no fruitful steps have been by the authority concerned.
Learned Standing Counsel has fairly contended that he has no objection if this Court issue a direction for early disposal of the above Reference.
In this conspectus as above, no useful purpose would be served to keep this matter pending, therefore, this Court deems it appropriate to finally disposed of the present writ petition, without making any observation on the merits of the case as mentioned in the present writ petition, with a direction to the Deputy Director of Consolidation, Jaunpur (respondent no. 1) before whom the above Reference is pending disposal, to decide the same expeditiously, preferably, within a period of six months from the date of receipt of copy of this order.
It is expected that the Deputy Director of Consolidation, Jaunpur shall decide the same by means of a reasoned and speaking order, strictly in accordance with law, after affording opportunity of hearing to the parties concerned and without granting unnecessary adjournment to either of the parties.
The petitioner shall file a computer generated copy of this order downloaded from the official website of the High Court, Allahabad, supported by an affidavit, which shall be verified by the authority concerned from the website of the High Court, Allahabad.
With the aforesaid observations, the present writ petition is disposed of.
