Heard learned counsel for the petitioners and the learned Additional Government Advocate.
Under challenge in the instant writ petition is the FIR. relating to Case Crime No.389 of 2010 under Section 379 I.P.C., Police Station Kotwali Utraula, District Balrampur We have gone through the contents of the FIR. Since it discloses commission of cognizable offence as such the same cannot be quashed. However, seeing the trivial allegations levelled in the FIR, we hereby direct that the petitioners, namely, Taufeek and Mazhar shall not be arrested in the aforesaid case crime till submission of the chargesheet/report under Section 173 Cr.P.C.
With the aforesaid directions, the writ petition is finally disposed of. Date : 22.6.2010.
