Heard learned counsel for the petitioner and counsel appearing for the caveator respondent nos.5 and 6.
The writ petition arises out of proceedings for mutation under Section 34 of the U.P. Land Revenue Act.
The three Courts below have decided against the petitioner and hence, this writ petition challenging the orders passed by the respondents 2,3 and 4.
Since, the orders impugned have been passed in summary mutation proceedings having purely fiscal connotations and since the findings returned in these proceedings do not bind the courts in regular title proceedings, this Court does not consider it expedient to entertain this writ petition.
Under the circumstance, this writ petition is dismissed granting liberty to the petitioner to sue for a declaration in his favour, in case so advised.
