By means of the present petition, the petitioners herein seek for quashing of the first information report dated 22.08.2021 bearing Case Crime No.290 of 2021 under Sections 147, 148, 149, 307, 189, 353, 336, 427 IPC & Section 7 of the Criminal Law (Amendment) Act' 2013, P.S.-Ganj, District- Rampur.
The contention of the learned counsel for the petitioners is that the petitioners have no concern with the incident-in-question which had occurred in front of the house of the petitioners. At no stage of the incident, the petitioners herein can be said to have been involved. They have falsely been implicated in the first information report.
All these submissions of the learned counsel for the petitioners cannot be examined within the scope of Article 226 of the Constitution of India, inasmuch as, the extent of involvement of the petitioners or the merits of the allegations in the FIR cannot be seen here.
From a reading of the FIR, it cannot be said that it does not disclose commission of a cognizable offence.
For the aforesaid, no interference can be made. Any interference at this stage may impede the process of speedy investigation.
The writ petition is found devoid of merits and hence
dismissed.
