Heard Sri Akhilesh Kumar Tripathi, learned counsel for the applicants, Sri G.P. Singh, learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicants that both the sides have received injuries in the incident. From the side of the applicants, an application u/s 156(3) Cr.P.C has been filed for lodging the FIR against the complainant party and others and the same is stated to be pending. The applicants along with their sister Priyanka also suffered injuries but the injured Jyoti received injuries on her head. He further submits that X-Ray could not be made available to him.
Learned A.G.A. have vehemently opposed the prayer for bail and submitted that as both the sides have received injuries, hence presence of the applicants at the place of occurrence appears to be admitted.
Without expressing any opinion on the merits of the case and considering the injuries sustained by injured Jyoti, the nature and gravity of the accusation, I find no good ground for grant of bail to the applicants Tarun and Arun involved in Case Crime No.324 of 2019, u/s 307 IPC, P.S. Brahmpuri, district Meerut.
Accordingly, the anticipatory bail application is rejected.
