Heard learned counsel for the petitioner and learned Standing Counsel for State-respondents.
The present petition has been filed seeking direction upon the second respondent to pass an order on the application preferred by the petitioner for recall of order dated 1st October, 2010.
It has been stated that the aforesaid application of the petitioner is maintainable under Rule 41 of the Workmen Compensation Rules, 1924, therefore the authority should address the said application.
Without expressing any opinion on the merits of claim of the petitioner, if any application has been moved by the petitioner and the same is pending, the authority must address the application and take appropriate decision thereon in accordance with law.
This petition is therefore disposed of by giving liberty to the petitioner to produce copy of the application, which has been filed before the concerned respondent, and demonstrate that the said application has been filed as per rules. If any such application is filed by the petitioner along with certified copy of this order, within next ten days, the respondent concerned shall address the application and pass reasoned order in accordance with law after giving opportunity of hearing to the other side, preferably, within next two months.
With the aforesaid liberty and direction, the petition stands
disposed off.
