Heard Ms. Tarannum Jahan in person, learned A.G.A. for the State and perused the record.
It is submitted by applicant herself that she has filed an application under Section 18, 18Ka, 18Kha, 19Ka, 19Kha, 19Cha, 20Ka, 20Kha, 20Ga, 22 & 23 of Protection of Women from Domestic Violence Act, 2005 which was allowed by the Additional Chief Judicial Magistrate, Court No.2, Bareilly vide order dated 10.1.2020 and the opposite party no.2 was directed to pay Rs.1,00,000/- and further pay Rs.10,000/- per month. It is further provided that opposite party no.2 shall provide one room to applicant and the opposite party no.2 was restrained to harass the applicant mentally or physically.
It is further submitted that opposite party no.2 in spite of full knowledge about the order dated 10.1.2020, had not complied the same and as such the applicant had filed an application for recovery of amount which was registered as Case No.56 of 2020.
Opposite party no.2 has put in appearance but has not filed any objection in that case.
It is further submitted that applicant has no source of income and she is unable to maintain herself and inspite of order dated 10.1.2020 nothing has been paid to applicant and his application for recovery of amount is still pending.
Considering the facts and circumstances of the case and without commenting on the merits of the case, A.C.J.M., Court No.2, Bareilly is directed to expedite the disposal of Case No.56 of 2020 expeditiously preferably within a period of three months from the date of production of copy of this order before it, if there is no legal impediment.
With the aforesaid directions, the application U/s 482 Cr.P.C. is disposed of.
