Heard learned counsel for the petitioner and learned Standing Counsel for State-respondent.
The petitioner is a fair price shop agent in village Mohalla Tarsi, Dhangaon District Mathura.
The license of the petitioner has been cancelled by the respondent no. 3 District Supply Officer, Mathura by order dated 16.5.2018.
Against the order dated 16.5.2018 the petitioner has preferred statutory appeal before Divisional Commissioner, Agra Division Agra/Joint Commissioner (Foods), Agra Division, Agra.
The submission of the petitioner is that Section 13(3) of Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016 provides that the Appellate Authority as for as possible should decide the appeal within a period of sixty days. Thus, the submission is that he has filed the appeal on 21.5.2018 and more than four months have passed but his appeal has not yet been decided.
Having heard the learned counsel for the parties, without adverting anything on merit and with the consent of the parties. The writ petition is disposed of with a direction to respondent no. 4 Divisional Commissioner, Agra Division Agra/Joint Commissioner (Foods), Agra Division, Agra before whom the appeal of the petitioner is pending, to dispose of the appeal expeditiously, preferably within a period of two months from the date of production of the certified copy of the order, if there is no legal impediment.
