The petitioner in the writ petition is seeking quashing of the order dated 17.4.2018 whereby she has been informed that without an order of the court of competent jurisdiction her name as the wife of Late Ramchhabila Ram cannot be interpolated in the LIC records. Earlier the petitioner had filed W.P. No. 5202 of 2018 with the claim that she was the second wife of Ramchhabila Ram and had married him after the death of his first wife and that she was entitled to terminal benefits. That writ petition was disposed of by a Division Bench of this court by order dated 8.2.2018 with a direction to the Varishtha Mandal Prabandhak, Life Insurance Corporation of India, Varanasi to decide the petitioner's representation. It is in pursuance thereof that the impugned order dated 17.4.2018 has been passed.
The question as to whether there was a valid marriage between the petitioner and late Ramchhabila Ram has to be decided by an appropriate civil court. Merely, because there is some certificate issued by the Tehsildar it would not result in the declaration of marriage of the petitioner with late Ramchhabila Ram.
We therefore do not find any illegality or infirmity in the impugned order. The writ petition lacks merit and is accordingly dismissed.
