Heard the learned counsel for the parties and perused the record.
Applicant-workman has since retired on attaining the age of superannuation on 12 February 2017. It is not in dispute that pursuant to the award dated 16 May 2000, applicant has received arrears of salary till December 2007. According to the learned counsel for the applicant, applicant is entitled to differential of salary in accordance with the award since 1 January 2008 till her retirement i.e. 12 February 2017.
Learned counsel for the opposite party submits that applicant has remedy of filing an appropriate application before the Labour Court for executing the remaining part of the award.
This fact is not being disputed by learned counsel for the applicant.
In view thereof, petition is disposed of as withdrawn with liberty to the applicant to make an appropriate application before the Labour Court for redressal of her grievance.
In the event, such an application is made, it is expected that the Labour Court shall decide the matter expeditiously, without granting unnecessary adjournment to either of the parties.
