Applicant has preferred the present Contempt Petition for non- compliance of the final judgment and order dated 11.1.2010 passed in Writ-A No.766 of 2010 (Tara Devi Vs. State of U.P. and Others). The operative portion of the order is reproduced hereinbelow-
"In view of the aforesaid position, this writ petition is disposed of with a direction to respondent No.2 to pass an appropriate order with regard to release of the fund to which the petitioner is entitled without any further delay in accordance with law as expeditiously as possible preferably within a period of 6 weeks from the date of production of a certified copy of this order before him.
With the aforesaid observations, the writ petition is disposed of."
An affidavit of compliance has been filed by the opposite party. In paragraphs 3 and 4, it is stated that the entire amount has already been paid to the applicant. On the other hand, it is argued by the counsel for the applicant that still certain dues are to be paid by the opposite party to the applicant.
Heard learned counsel for the parties and perused the record.
In the facts and circumstances of the case, if the applicant certain dues are still to be paid, the applicant is permitted to submit a fresh representation ventilating all his grievances along with copy of this order within a period of four weeks from today. If any such representation is made, the opposite party is directed to pass a fresh and appropriate order expeditiously preferably within a period of six months thereafter.
The writ petition is accordingly disposed of.
