The mother, Smt. Tapeshari Devi, has filed this petition seeking direction from this Court for fair investigation.
Pursuant to previous order passed by this Court, Shri Vimlesh Kumar, Sub Inspector of P.S.Sevrahi, District Kushi Nagar is present. He submits that daughter of the petitioner has already been recovered on 13.12.2019 and she is under the safe custody.
Counsel for the petitioner submits that direction may be issued to the police authorities to medically examine the daughter of the petitioner Sarita and her statement under Section 164 Cr.P.C. may also be recorded. He further submits that custody of the petitioner's minor daughter be also given to her.
Counsel for the State has no objection to this proposition.
The writ petition is disposed of directing the police authorities to get the prosecutrix medically examined and make necessary arrangements for recording her statement under Section 164 Cr.P.C.
Meanwhile, custody of the prosecutrix may also be given to the petitioner.
