Heard Sri S.M.A.Abdy, learned counsel for the petitioner and learned Standing Counsel for the State respondents.
The petitioner had taken permit for stage carriage after purchase of Maxi Cab for a particular route. The petitioner plied the said vehicle for a period of three years. Due to personal reason, the petitioner has now moved an application for cancellation of permit and prays for granting a private registration to the said vehicle as the petitioner no longer desires to ply the said vehicle commercially.
It is submitted that the Bank has already issued No Dues Certificate and no tax liability is pending upon the petitioner and there is no other legal impediment in cancelling the permit and for registering the vehicle as a private vehicle of the petitioner. The application of the petitioner has been filed before the respondent no.2, which is still pending and no decision has been taken as yet.
The writ petition is disposed of with the direction to the respondent no.2 to consider the claim of the petitioner and if there is no other legal impediment, cancel the permit of the vehicle being registration no. UP 50 AT-6634 and register the said vehicle as a private vehicle in the name of the petitioner. Such an order be passed within a period of two months from the date of presentation of a certified copy of this order.
