The defendant-petitioner is before this Court assailing the order dated 31.7.2018 passed by Civil Judge (JD), Meerut by which the application 43-Ga filed by the petitioner-defendant no.7 under Section 9 of Court Fees Act has been rejected.
The Court has proceeded to examine the record in question and find that against the order impugned the petitioner has got efficacious alternative remedy and as such this Court cannot come for rescue and reprieve of the petitioner under Art.227 of the Constitution of India.
The writ petition is dismissed on the ground of alternative remedy.
