Following orders were passed in the matter on 15.7.2019:-
" Learned Standing Counsel may obtain instructions from the District Programme Officer, Etawah as to whether the shortcomings intimated vide letter dated 19.03.2014 by the office of the Accountant General has been rectified or not.
Post this matter, as fresh, on 22.07.2019. "
Learned Standing Counsel has obtained instructions from the District Program Officer, Etawah, according to which all retiral benefits payable to petitioner from the date of his regularisation i.e. 1.1.1995 has already been paid to her.
Learned counsel for the petitioner submits that petitioner's initial adhoc appointment followed by regularisation is also liable to be included towards qualifying service for payment of retiral benefits, keeping in view the provisions contained under Rule 3 (8) of the of the ' The Uttar Pradesh Retirement benefits Rules, 1961'. Submission is that this aspect of the matter has not been taken into consideration.
Considering the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon the respondent no.3 to accord consideration to the petitioner's claim for counting of service of her husband from 1991 to 1995 in accordance with the provisions in Rule-3 (8) of the Rules of 1961 and appropriate decision in that regard would be taken within a period of three months from the date of presentation of certified copy of this order. All consequential actions shall be taken accordingly.
