JUDGMENT / ORDER

It appears that post the filing of petition, the respondent has issued a communication concurring to the appointment of Mrs.Justice Chitra Venkataraman, a retired Judge of this Court, as the Sole Arbitrator and thus, this petition does not survive. However, learned counsel for the parties state that in the arbitration proceedings, the Commissioner of Customs would be impleaded as a party.
2.The aforesaid statement is taken on record.
Original petition is, accordingly, disposed of, leaving the parties to bear their own costs.
