Heard Sri A.K.Pandey, learned counsel for the petitioners,Sri G.P.Singh, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
This petition has been filed by the petitioners with a prayer to quash the FIR dated 10.8.2018, registered as case crime No.598 of 2018, under Sections 147, 353, 332, 427, 308, 506 I.P.C. and 3A & 3B of Uttar Pradesh, Chiktsha Paricharcha Sewa Karmi and Chiktsha Paricharcha Sewa Sansthan (Hinsa or Sampati Ka Chati Ka Niwaran Adhiniyam, 2013), P.S., Medical College, District Meerut.
Learned counsel for the petitioners submits that the respondent no.3 has lodged the impugned FIR against the petitioners as well as other persons only to create pressure upon the employees of the Medical College and office bearers and employees union as the President of employees union as well as other officers made a complaint against the respondent no.3. He further submits that the petitioners are innocent and have no criminal history except the present case. The allegations levelled against the petitioners are false, frivolous and baseless. No offence is made out against the petitioners, hence, FIR is liable to be quashed by this Court.
Learned A.G.A.opposed the prayer for quashing of the FIR.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but they shall co-operate with the investigation of the case.
With the above direction, this petition is finally disposed of.
