ORDER:
This writ petition is filed for the following substantive relief:
“For the reasons stated in the accompanying affidavit, it is therefore prayed that this Hon’ble Court may be pleased to issue a Writ, one in the nature of Writ of Mandamus or any other appropriate Writ, direction or order declaring the action of the respondents in not continuing the petitioner as an authorized permanent fair price shop dealer of F.P.Shop No.33, Vankayapadu Village, Inkollu Mandal, Prakasam district and making in-charge arrangements to another person as illegal and arbitrary and violative of the provisions of the Andhra Pradesh Schedule Commodities Control Order, 2008, and consequently direct the respondents to continue the petitioner as an authorized permanent fair price shop dealer of F.P. Shop No.33, Vankayapadu Village, Inkollu Mandal, Prakasam District in the interest of justice.”
On the direction issued by this Court, respondent No.4, who has forwarded the petitioner’s purported resignation for acceptance, has been present. He has stated that as the petitioner has submitted his resignation on personal ground, he has forwarded the same to respondent No.3.
At the hearing, learned Government Pleader for Civil Supplies (Andhra Pradesh) has placed before this Court proceedings vide Rc.J/1146/2014, dated 21.08.2014, whereby respondent No.3 has accepted the petitioner’s resignation.
Without adverting to the allegations levelled against the official respondents, this Court feels that interests of justice would be met, if the resignation of the petitioner is permitted to be withdrawn and the above-mentioned proceedings accepting resignation of the petitioner is set aside.
Accordingly, the petitioner is permitted to withdraw his resignation, the above-mentioned proceedings issued by respondent No.3 is set aside and the respondents are directed to continue the petitioner as fair price shop dealer.
Subject to the above direction, the Writ Petition is allowed.
As a sequel to disposal of main petition, WPMP.No.48710 of 2014 filed by the petitioner for interim relief is disposed of.
