1. Heard Mr. Shivang M. Shah, learned advocate for the petitioner and Mr. Rajesh Chauhan, learned advocate for Mr. H.S. Munshaw for respondent Nos.1 and 2 as well as Mr. Niraj Ashar, learned AGP for respondent No.3.
2. Mr.
Shivang Shah, learned advocate for the petitioner submitted that in fact in an identical fact situation, this Court has directed the respondents to decide the representation within a period of 15 days from the receipt of copy of the order. The learned advocate for the petitioner relying upon the judgment and order dated 17.8.2011 passed in Special Civil Application No.10887 of 2011 in the case of Mansukh Manilal Parjiya Vs. District Primary Education Officer submitted that a similar order also deserves to be passed in the present petition.
3. Mr.
Rajesh Chauhan, learned advocate for Mr. H.S. Munshaw for respondent Nos.1 and 2 and Mr. Niraj Ashar, learned AGP for respondent No.3 submitted that taking into consideration the facts of this case, a similar order may be passed as directed earlier by this Court in the case of Mansukh Manilal Parjiya (supra). In view of the aforesaid facts and the prayers prayed for in the present petition, the petitioner is directed to file a detailed representation to all the three respondents within a period of two weeks from today and the respondents shall consider the same in accordance with law within a period of three months from the date of receipt of such a representation. It is, however, made clear that this Court has not examined the matter on merits and this direction is issued mainly considering the fact that in an identical matter, such directions have been issued.
4. With these observations, the petition is disposed of. Notice discharged. No order as to cost.
