Learned APP, Mr.Pandya, waives service of notice of rule on behalf of respondent-State.
The present application has been preferred by the applicants-convict for temporary bail on the ground that they want to attend the marriage of son of their sister.
Pursuant to the oral direction given by this Court, learned APP based on the report received by him from Ghogha Police Station states that the marriage is fixed but Kanubhai Govindbhai Zapadia is the real brother in law and Tansukhbhai Govindbhai Zapadia is brother of Kanubhai Govindbhai Zapadia.
Under the circumstances, the ground is genuine. However, both the applicants cannot be released for one ground.
Under the circumstances, the one of the convict Kanu @ Kanubhai Govindbhai Zapadia be released on temporary bail from 25th January, 2012 to 31st January, 2012 on personal bond of Rs.5000/- (Rupees Five Thousand Only) and one surety of the like amount and with the further direction that upon the expiry of the period, he shall surrender with the Jail Authority. So far as other co-convict Tansukh @ Tanso Govindbhai Zapadia is concerned, his application does not deserve to be granted. Therefore, dismissed.
Application disposed of accordingly. Rule made absolute. Direct service today is permitted.
