Heard learned counsel for the applicants and learned AGA for the State.
There are two criminal appeals, namely Criminal Appeal No. 10 of 2017 (Amardeep Vs. State of U.P.) and Govt. Appeal No. 16 of 2017 ( State Vs. Smt. Usha and others) arising out of judgement and order dated 31.03.2017 passed by Additional Chief Judicial Magistrate, Court No.2 Muzaffar Nagar convicting few of the accused persons under Sections 498A, 323, 377, 504, 506 IPC and Section 3/4 D.P.Act, P.S. Kandhla, District Shamli.
The aforesaid appeals are pending before the District and Sessions Judge, Shamli, it is prayed that the applicant is lady and residing at House No. 86, village Matnauli, P.S. Kandhla,District Shamli and facing upheld task to appear before the Shamli Court on the ground that she is being faced against the formidable offence. This is purely law and order situation where the applicants is facing immense threat from the opposite party in the case.
The applicant Smt. Tannu may approach to S.S.P., Muzaffarnagar within a month and submit a representation before him narrating all the threat perception to her. S.S.P., Muzaffarnagar will pass a reasoned order strictly in accordance with law.
With the aforesaid observation, the application is disposed of.
