This Civil Revision Petition is filed to direct the learned District Judge, Kanyakumari at Nagercoil, to dispose of the first appeal in A.S.No.62 of 2014, within a stipulated time that may be fixed by this Court.
2. The respondents 1 and 2 filed O.S.No.175 of 2011 before the II Additional Subordinate Court, Nagercoil, for declaration and permanent injunction. The said suit was decreed on 07.08.2014. Against the said judgment and decree, dated 07.08.2014, the petitioner/8th defendant filed A.S.No.62 of 2014 before the District Court, Kanyakumari at Nagercoil, and the same is pending.

The contention of the learned counsel for the petitioner is that the petitioner/8th defendant filed A.S.No.62 of 2014 on 18.08.2014 before the District Court, Kanyakumari at Nagercoil, and it was posted for arguments on 30.01.2015. From that date onwards, the appeal is being adjourned without taking it for final hearing. In the circumstances, the petitioner has come out with the present Civil Revision Petition to dispose of the first appeal in A.S.No.62 of 2014.
4. I have heard the learned counsel for the petitioner and perused the materials available on record.

Having been taken into consideration of the material facts and circumstances, this Court is of the view that in the interest of justice, it may be expedient to issue a direction to the first appellate Court. Accordingly, this Civil Revision Petition is allowed and the learned District Judge, Kanyakumari at Nagercoil, is directed to dispose of A.S.No.62 of 2014 as expeditiously as possible, in any event, not later than 31.07.2017. No costs.
