Prayer in W.P.(MD) No.2133/2013: Petition filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the respondents Nos. 1, 3 and 4 and also their personnel or hired employees/workmen not to conduct any unauthorized survey covered under Survey No.179/1 in Kulathur Revenue Village, Vilathikulam Taluk, Thoothukudi District on the basis of the petitioner association's representations dated 25.06.2012 and 03.12.2012.
Prayer in W.P.(MD) No.7518/2014: Petition filed under Article 226 of the Constitution of India, to issue a writ of Mandamus or any other appropriate writ or order or direction in the nature of writ directing the respondents and also their personnel or hired employees/workmen not to conduct any unauthorized survey covered under Survey Nos.40/2B2B, 40/3A, 40/3B, 40/3C, 41/1B, 41/2A1, 2A2, 2B, 2C1, 2C2, 2D, 49/2A, 51, 52/1A, 52/1B, 52/2, 53/1, 53/2, 54/1, 54/2B, 103, 104/5, 104/6A, 104/6B, 105/2, 105/3, 106/1, 137 in Chettaimallanpatti Village, Srivaikundam Taluk, Tuticorin District.
These writ petitions have been filed, seeking to direct the respondents Nos. 1, 3 and 4 and their personnel or hired employees/workmen not to conduct any unauthorized survey covered under Survey No.179/1 in Kulathur Revenue Village, Vilathikulam Taluk, Thoothukudi District on the basis of the petitioner association's representations dated 25.06.2012 and 03.12.2012 and also in respect of Survey Nos.40/2B2B, 40/3A, 40/3B, 40/3C, 41/1B, 41/2A1, 2A2, 2B, 2C1, 2C2, 2D, 49/2A, 51, 52/1A, 52/1B, 52/2, 53/1, 53/2, 54/1, 54/2B, 103, 104/5, 104/6A, 104/6B, 105/2, 105/3, 106/1, 137 in Chettaimallanpatti Village, Srivaikundam Taluk, Tuticorin District
2. Heard the learned counsel on either side.
3. These writ petitions have arisen pursuant to the reply received under the Right to Information Act, wherein it has been stated that there is a proposal to acquire the land, but the said proposal has not yet attained any finality and therefore, based on the apprehension of the petitioners, no order can be passed in these writ petitions.
4. Hence, these writ petitions are disposed of, leaving it open to the petitioners to approach this Court, after due notification of the acquisition proceedings in formal. No costs. Consequently, connected miscellaneous petitions are closed.
