Tamilnadu Housing Board ... vs The Secretary To Government

Madras High Court|16 June, 2017

JUDGMENT / ORDER

The petitioner-Tamil Nadu Housing Board Engineers Association seeks for a direction to the respondents to extend the benefit of G.O.312 dated 26.8.2010 and to grant the revision of scale of pay and grade pay on par with the other department/public sector undertakings within a reasonable time.
2. Learned counsel for the petitioner submitted that all the members of the petitioner Association are not given the benefit of G.O.312 dated 26.8.2010.
3. But this Court is not inclined to entertain the writ petition filed by the petitioner Association. The reason is that when the benefit of G.O.Ms.No.312, Finance (Pay Cell) Department dated 26.8.2010 is sought for, every individual member has to make out a case before this Court. Therefore, without any basis or foundation, the petitioner cannot press that the members of the petitioner Association are entitled to get the benefit of the aforementioned Government Order. Hence, the writ petition filed by the Association is bereft of any locus standi. Accordingly, the writ petition fails and it is dismissed. However, liberty is given to the individual members to workout their remedy in the manner known to law. No costs.
