Tamil Nadu Thaniyar Palli Asiriar ... vs 2 The Cor

Madras High Court|06 April, 2017

JUDGMENT / ORDER

Since no order prejudicial to the interest of the second respondent is passed, notice to the second respondent is dispensed with and with the consent of the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the first respondent, this writ petition is taken up for final disposal.
2 This writ petition has been preferred seeking to issue a writ of mandamus directing the first respondent to dispose of the petitioner's representation dated 17.03.2014 by initiating proceedings against the second respondent physical education college and take over the Management of the second respondent physical education college and appoint Special Officer for administering the second respondent Management.
3 The petitioner is an association of teachers of private schools. Bringing to light, the various irregularities in the management of the second respondent institution, the petitioner association addressed a representation dated 17.03.2014 to the first respondent, viz., the Joint Director, College Education, Chennai. Since the said representation dated 17.03.2014 has been remaining with the first respondent unconsidered, the petitioner association preferred the instant writ petition in 2014.
4 Today, when the matter was taken up for hearing, a copy of the communication dated 28.10.2014 from the first respondent addressed to the petitioner was produced before this Court, wherein, the petitioner has been required to furnish a copy of the representation dated 17.03.2014 to the first respondent.
5 In view of the above and considering the limited scope of the relief sought by the petitioner association, without going into the merits of the case, this Court directs the petitioner to submit a copy of the representation dated 17.03.2014 to the first respondent within a period of one week from the date of receipt of a copy of this order and upon receipt of a copy of the petitioner's representation, the first respondent shall consider and pass orders on the same on its own merits and in accordance with law within a period of four weeks.
With the above directions, this writ petition stands disposed of. Costs made easy.
