Since no order prejudicial to the interest of the second respondent is passed, notice to the second respondent is dispensed with and with the consent of the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the first respondent, this writ petition is taken up for final disposal.
2 This writ petition has been preferred seeking to issue a writ of mandamus directing the first respondent to dispose of the petitioner's representation dated 20.05.2013 by initiating proceedings against the second respondent and take over the Management of the second respondent school and appoint Special Officer for administering the second respondent Management.
3 The petitioner is an association of teachers of private schools. Bringing to light, the various irregularities in the management of the second respondent school, the petitioner association addressed a representation dated 29.03.2013 to the first respondent, viz., the District Collector, Chennai and followed it up with a reminder dated 20.05.2013. Since its representation dated 29.03.2013 and its reminder dated 20.05.2013 have been remaining with the first respondent unanswered, the petitioner association preferred the instant writ petition in 2014.
4 Considering the limited scope of the relief sought by the petitioner, without going into the merits of the case, this Court directs the first respondent to consider and pass orders on the petitioner's representation dated 20.05.2013 on its own merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
With the above direction, this writ petition stands disposed of. Costs made easy.
