JUDGMENT / ORDER

About 45 demands having been raised by the petitioner touching upon various issues pertaining to confirmation, fixation of pay scale, bonus, house allowance and other incidental benefits, the first respondent has gone into the merits of the demands and declined the reference. Challenging the same, the present writ petition has been filed.
2. As rightly submitted by the learned counsel for the petitioner, the first respondent has clearly exceeded his jurisdiction by going into the merits of the case. The decision relied upon by the learned counsel for the petitioner in W.P.No.3789 of 2015 dated 22.12.2015 against the very same respondents would govern the case.
3. Despite notice having been served on the contesting respondent, he has not appeared before this Court.
4. In such circumstance, the order impugned is hereby set aside and the writ petition stands allowed with the consequential direction to the first respondent to refer the dispute raised to the second respondent within a period of eight weeks from the date of receipt of a copy of this order. It is made clear that all the issues are left open to be decided by the second respondent. No costs. Consequently, connected miscellaneous petition is closed.
