[Order of the Court was made by M.M.SUNDRESH, J.] Heard Mr.G.Karnan, learned Counsel appearing for the appellants and Mr.S.Anwar Sammem, learned counsel appearing for the respondent.
2. The appeal is directed against the order passed by the learned Single Judge remitting the matter for fresh consideration to the appellants on the question of quantum of punishment alone. In other words, the charges as found were not disturbed by the learned Single Judge. The learned Single Judge took into the attending circumstances for coming to the conclusion. We do not find any illegality in the order passed by the learned Single Judge.
3.In such view of the matter, we are not inclined to interfere with the order passed by the learned Single Judge. Hence, the appeal is dismissed. No costs. Consequently, connected miscellaneous petition is also closed.
