Heard learned counsel for the petitioner and Sri Gyanesh Kumar Mishra, holding brief of Sri Krishna Mohan Asthana, learned counsel appearing for respondent No.4. Learned Standing Counsel appears for respondent nos. 1,2 and 3.
This petition has been filed with the following prayers:-
"(I) Issue a writ, order or direction in the nature of mandamus commanding and directing to the bank for deposit the recovery loan amount according to the order of the Hon'ble High Court dated 27.2.2018".
It appears from the record that earlier a writ petition was filed by the petitioner being Writ-C No. 7902 of 2018, which was disposed of on 27.2.2018 directing the petitioner to deposit the amount in ten equal six monthly installments. It appears that the petitioner has defaulted in complying with the order of the Court. This second petition has been filed seeking further time for payment of the installments.
Learned counsel for the respondent has strongly urged that the respondent No.4, which had granted loan to the petitioner is a private banking company and, therefore, no writ petition would lie against the company. Even otherwise, it is stated, that once indulgence had been granted by this Court, no further indulgence may be granted looking into the fact that the petitioner is using the forum of this Court to delay repayment of the loan.
The contention of the learned counsel for the respondent appears to be correct. Therefore, no further indulgence can be granted by this Court in this writ petition.
This petition is wholly lacking in merit and is, accordingly, dismissed.
