JUDGMENT / ORDER

. Respondent/Complainant Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to direct the Station House officer, Rapur Police Station, SPSR Nellore to release the petitioners on bail in the event of their arrest in connection with Crime No. 20 of 2014 of Rapur Police Station, SPSR Nellore District in the interest of justice..
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri D.Purnachandra Reddy, Advocate for the Petitioners and of the Public Prosecutor, for the Respondent, the Court made the following.
ORDER:
“The petitioners are A4 and A5. They seek for grant of anticipatory bail. They allegedly committed an offence under Section 379 IPC. The offence is triable by a Magistrate of First Class. It would be appropriate for the petitioners to surrender before the trial Court and move the trial Court for grant of regular bail.
However, the first petitioner/A4 is described to be 65 years old. In view of the age of the first petitioner/A4, I consider it appropriate to enlarge the first petitioner on anticipatory bail.
Accordingly, this Petition is allowed so far as the first petitioner/A4 is concerned. The first petitioner shall surrender before the Judicial Magistrate of First Class, Venkatagiri, within two weeks from today. On such surrender, the learned Judicial Magistrate of First Class, Venkatagiri, shall enlarge the first petitioner on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum to his satisfaction.
So far as the second petitioner/A5 is concerned, this petition is disposed of giving liberty to the second petitioner to surrender before the trial Court and move the trial Court for grant of regular bail. In such an event, the Trial Court shall consider such an application on merits, without being influenced by any part of this order, and shall dispose of the same on the same day on which it is filed.
