JUDGMENT / ORDER

The writ petition is filed, inter alia, seeking the following reliefs: “i. issue a writ of mandamus or any other writ order or direction to the 1st respondent to pass orders of bifurcation of the area assets and liabilities pursuant to the Exhibit P8 order before 20.06.2014.
ii. command the 3rd respondent to furnish necessary report as ordered in Exhibit P8 with the modification contained in Exhibit P10 judgment forthwith, to the 1st respondent.”
2. Apparently, the bifurcation proceedings pursuant to Ext.P8 order is continuing in so far as four villages have to be bifurcated pursuant to Exts. P8 and P10 orders. In the mean time, the period for which the managing committee has been elected is going to expire and they have to conduct fresh election. The apprehension expressed by the petitioner is that due to the pendency of the bifurcation proceedings, there will be delay in the conduct of election.
3. It is not in dispute that even if the bifurcation proceedings are pending, it shall be open for the society to W.P.C.No.14214 OF 2014 2 proceed with the election provided they take appropriate resolution in that regard. In fact, learned Senior Government Pleader on behalf of the respondent submits that the resolution for conducting election can be taken by the society without insisting for completing the bifurcation proceedings.
The above submission is recorded and this writ petition is disposed of.
