This Criminal Petition is filed under section 482 Cr.P.C. to quash the FIR in Crime No. 287 of 2011 of V-Town Police Station, Nellore, registered for offences under section 323, 506 read with section 34 of IPC.
2. When the matter is posted on 02/11/2012 none appeared for petitioner and the matter is directed to be posted on 05/11/2012 under the caption of dismissal. On 05/11/2012 when the matter is posted under the caption of dismissal, it is represented that counsel for the petitioner is unwell and again it is directed to be posted on 14/11/2011 under the same caption of dismissal but it was not dismissed and it is again listed on 03/4/2014. As no one appeared, it is posted to this day under the caption of dismissal. Now request is made on behalf of counsel for petitioner to adjourn the case. As seen from the record, after obtaining stay no interest is evinced in prosecuting the case. This is third time the matter is posted under the caption of dismissal; first it was posted on 5/11/2012 by an order dated 02/11/2012, secondly on 14/11/2012 by an order dated 05/11/2012 and lastly this day by an order dated 03/4/2014. Therefore, I am not inclined to grant any adjournment, Since investigation of FIR in Crime No.287 of 2011 is stalled on account of this criminal petition, I feel that this criminal petition is liable to be dismissed.
3. Accordingly, this Criminal Petition is dismissed for non- prosecution.
