1. Called in revise. None appeared to press this revision. In the circumstances, I myself have perused the record.
2. This criminal revision under Section 397/401 Cr.P.C., has been filed aggrieved by the judgment and order 31.01.1989. The First Assistant Sessions Judge, Saharapur vide judgment dated 23.09.1988 convicted revisionist and sentenced him to undergo four years rigorous imprisonment with fine of Rs. 500/- for the offence under Section 368 IPC. Thereagainst, revisionist preferred Criminal Appeal No. 61 of 1988 and Appellate Court while dismissing appeal confirmed the conviction under aforesaid Section but reduced the sentence from four years to two years rigorous imprisonment with fine of Rs. 500/- under Section 368 IPC. Being aggrieved the revisionists preferred present revision.
3. Having gone through the record, I do not find any manifest error or otherwise illegality, procedural or otherwise, so as to justify interference in criminal revision.
4. Dismissed. Interim order, if any, stands vacated.
5. The accused, Tahsin, is on bail. His bail bonds and surety bonds are cancelled. The Chief Judicial Magistrate concerned shall cause him to be arrested and lodge in jail to serve out the sentence passed against him. The compliance shall be prepared within two months.
6. Certify this judgment to the lower Court immediately.
