Heard learned counsel for the petitioner, learned Standing Counsel for the respondent no.1 and Sri Rahul Agarwal, learned counsel appearing for the respondent nos. 2 and 3.
The case of petitioner is that her husband was appointed on the post of Driver in U.P. State Roadways Transport Corporation Ltd., (hereinafter referred to as the, 'Corporation'). During the course of service, her husband has taken Voluntary Retirement Scheme (in short, 'V.R.S') on 30.06.2002. After that, he died on 07.05.2017. After the death of her husband, petitioner has submitted several representations to the authorities concerned to provide pension, but authorities have not taken any action. For redressal of her grievance, petitioner has submitted one more representation dated 04.08.2018 before the respondent nos.2 and 3, but the same has not been decided till date.
Learned counsel for the petitioner has lastly prayed that a suitable direction may be issued to respondent no.2 to decide the representation of the petitioner dated 04.08.2018 within time bound manner.
Learned Standing Counsel as well as Sri Rahul Agarwal, learned counsel appearing for the respondent nos. 2 and 3 has no objection to the prayer made by the learned counsel for the petitioner.
Considering the facts and circumstances of the case, with the consent of the parties, without adverting on the merits of the case, the petition is disposed of with a direction to respondent no.2, Managing Director, U.P. State Roadways Transport Corporation Ltd., Lucknow to decide the representation of the petitioner dated 04.08.2018 strictly in accordance with law within a period of two months from the date of production of certified copy of this order. Petitioner is given liberty to file a fresh representation along with certified copy of this order.
