Heard Sri Ujjawal Satsangi, learned counsel for the petitioner, Sri Gaurav Pratap Singh, learned Brief Holder for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner for a direction to the respondents not to proceed with the confiscation or attachment of the property belonging to the petitioner at Arazi No.390, village Garauda, Pargana Muaiylee, Tehsil Chunar, District Mirzapur in pursuance of Case No.61103 of 2016 pending before CJM, Sonbhadra arising out of Case Crime No.494 of 2015 under sections 304/286 IPC and 4/5 Explosive Substances Act, Police Station Obra, District Sonbhadra .
Learned counsel for the petitioners submits that the petitioner is the mother of the accused who is stated to be absconding and proceedings under sections 82 and 83 Cr.P.C. has been initiated by the Magistrate concerned with respect to the property of the son of the petitioner. The police is proceeding for attaching the property of the son of the petitioner. She has also approached the S.P. Mirzapur and Sonbhadra.
The S.P. Sonbhadra shall look into the matter in accordance with law.
With the above direction this petition is finally disposed of.
