Heard learned counsel for the applicant, learned A.G.A. and perused the record.
This bail application has been moved by the applicant Tahir @ Teru who is involved in Case Crime No. 605 of 2017, under Sections 3/5/7/25 Arms Act and Section 4/5 Explosive Substance Act, 1908, Police Station-Bhopa, District-Muzaffar Nagar.
As per prosecution version, on 14.8.2017 at about 5:30 PM co- accused Firdosh was apprehended by the police on the spot while manufacturing country made pistol. From the spot, two country made pistol and two rifle alongwith some other related articles were recovered from co-accused Firdosh. Applicant and co-accused Abid fled away from the spot.
Learned counsel for the applicant contended that the applicant has no criminal history and there is no public witness of the alleged recovery. He further contended that co-accused Firdosh has already been enlarged on bail vide order dated 26.10.2017 passed by this Court in criminal misc. bail application no. 40533 of 2017.
Learned A.G.A., has opposed the prayer for bail.
Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail. Let the applicant-Tahir @ Teru, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the C.J.M./Magistrate, concerned.
Application stands allowed.
