Heard learned counsel for the applicant, learned A.G.A. and perused the record.
This bail application has been moved by the applicant Tahir Ali who is involved in Case Crime No. 82 of 2018, under Sections 419, 420 I.P.C., and Section 18 (C), 27 of the Drugs and Cosmetic Act, 1940, Police Station-Bhot, District-Rampur.
As per prosecution version, on 21.4.2018 at about 2:00 PM applicant was apprehended by the police, selling medicine without having valid licence.
Learned counsel for the applicant contended that applicant has been falsely implicated in the present case due to enmity. There is no any chemical examination report to show that the alleged recovered medicine is adulterated. Applicant has no criminal history and he is in jail since 21.4.2018.
Learned A.G.A., has opposed the prayer for bail, however, admitted this fact that the applicant has no criminal history.
Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail. Let the applicant-Tahir Ali, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the C.J.M./Magistrate, concerned.
Application stands allowed.
